Thank you for visiting Colorectal Cancer Alliance (hereinafter the Alliance or Colorectal Cancer Alliance). The Terms and Conditions, Privacy Policy and all other stated rules constitute a legally binding agreement between you and the Colorectal Cancer Alliance. These terms and conditions govern your use of this website and any other website launched by the Alliance from time to time as well as the tools, services, mobile application, social media, and any other digital platform or other service operated or used by the Alliance (Sites). By using the Sites, you are agreeing to these Terms and Conditions. The Alliance reserves the right to change these Terms and Conditions from time to time.

Description of Colorectal Cancer Alliance Services


As part of its mission to provide resources to the colorectal cancer community, the Alliance maintains several digital platforms available to the general public. These platforms include but are not limited to the Alliance website, the Alliance Patient and Family Journey, and the Alliance web-based screening navigation tool.

Information Provided Through the Sites - Disclaimer


Information and services provided to you through the Sites are for informational purposes only. The information and services are not intended to be substitutes for medical or health advice, diagnosis, or treatment. You hereby warrant and represent that you are at least eighteen (18) years of age (21 in some jurisdictions) and have the legal capacity to use the Sites. The Alliance makes no representation or warranty that the content provided on the Sites complies with the local laws of your jurisdiction. You are solely responsible for knowing and understanding your local laws. If you are unable to make the representations and warranties contained herein, do NOT use the Sites.

Unless otherwise indicated, Colorectal Cancer Alliance holds the copyright to all materials on the Sites, including text, graphics, logos, icons, images audio/visual clips and design. Additionally, Colorectal Cancer Alliance owns all of the trademarks, service marks and logos (“Marks”) used and displayed on the Sites, unless otherwise noted. Without the explicit consent of Colorectal Cancer Alliance, no material from the Sites, including the Marks, may be copied, reproduced, displayed, republished, downloaded, posted, transmitted or distribute in any way. Any unauthorized use of materials contained on this site may violate copyright.

Privacy


Your privacy is important to us and we are committed to protecting your information in accordance with applicable laws and regulations and consistent with our established policies. Our Privacy Policy that can be found at https://www.ccalliance.org/privacy-policy and supplements these Terms and Conditions and further describes how the Alliance collects information about you through the Sites, and how we use, disclose, and protect that information.

No Warranty; Limitation of Liability


The Sites and all services, materials, information, products, and tools included in or available through the Sites are provided “as is” and “as available” without warranty of any kind, express or implied. The Alliance disclaims all express and implied warranties with regard to the Sites and all services, materials, information, products, and tools included in or available through the Sites, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Check your applicable laws for any restrictions or limitations regarding the exclusion of implied warranties.

The Alliance makes no representations of any kind, expressed or implied: (i) regarding the safety, accuracy, or efficacy of the Sites, or the information stored on the Sites; (ii) that the Sites will operate in a manner that is uninterrupted or error-free, or (iii) regarding any other subject matter of this Agreement.

Under no circumstances, including but not limited to negligence, shall the Alliance and its subsidiaries, affiliates, officers, agents and employees be liable for any direct, indirect, special, incidental, punitive or consequential damages of any kind, or any damages whatsoever, including, but not limited to, damages for loss of profits, goodwill, data or other intangible losses, resulting from the use or the results of the use of the Sites, from statements or conduct of any third party using the Sites, or from failure of performance, error, mistake, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, mistakes, inaccuracies or typographical errors, acts of god/acts of nature/acts of terrorism, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of the Sites, or any other matter relating to the Sites, whether for breach of contract, tortuous behavior, antitrust, negligence, or under any other cause of action or theory of liability.

The Alliance does not warrant that the Sites will be uninterrupted or free of technical or other inaccuracies, mistakes, or typographic or other errors, that defects will be corrected, or that the website or server that makes the website available are free of viruses or other harmful elements.

You acknowledge and agree that the limitations set forth above are fundamental elements of these Terms and Conditions and the Sites would not be provided to you absent such limitations.

Liability Release; Indemnification


You agree to indemnify and hold the Alliance and its subsidiaries, affiliates, officers, agents and employees, harmless from and against any and all claims or liability, including costs and attorney's fees, arising from or in connection with your use of the Sites or anything related to the Sites, your violation of these Terms and Conditions, or your violation of any rights of another or your failure to abide by applicable law. You hereby release and waive any and all claims and/or liability against the Alliance and its subsidiaries, affiliates, officers, agents and employees arising from or in connection with your use of Sites or anything related to the Sites. We reserve, and you grant us, the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you. This Section shall survive termination of this Agreement.

 

Links Third-Party Sites


Our Sites may include links to other websites that are not owned or controlled by the Alliance, and the Alliance is not responsible for the contents of any linked site, the conduct of any linked site, or any changes or updates to such sites.

The Alliance may provide links to you only as a convenience, and the inclusion of any link does not imply an endorsement by the Alliance of the website. You should read the privacy policy of the third-party provider to see how your information will be treated on its sites.

Term and Termination


Either party may terminate these Terms and Conditions at any time. You understand that you are solely responsible for backing up the data that you store on the Sites, and that upon termination, you must immediately discontinue use of the Sites. This section of this Agreement, as well as other provisions that should by their context survive, shall survive termination of these Terms and Conditions for whatever reason.

Passwords/Security


If you have been provided with a username and password to access sections of the Sites, you understand agree that your username and password is unique to you and the username and password cannot be shared with or used by anyone other than yourself. You agree that you will not provide anyone else other than yourself with access to the website and/or forums via your username and password. If you do not have a valid username and password, you are not authorized to use or access password protected areas.

Statute of Limitations


Regardless of any statute or law to the contrary, you must file any claim or cause of action airing out of or related to the Sites within one (1) year after such claim or cause of action arose or be forever barred. This Section shall survive termination of this Agreement.

Governing Law


In the event any of the Terms and Conditions shall be held to be unenforceable, the remaining terms and conditions shall be unimpaired and the unenforceable term or condition shall be replaced by such enforceable term or condition as comes closest to the intention underlying the unenforceable term or condition. The Sites (excluding linked sites) are controlled by the Alliance from an office within the District of Columbia, United States of America. By accessing the Sites, you and the Alliance agree that all matters relating to the Sites shall be governed by the laws of the District of Columbia, without regard to choice of law principles. You and the Alliance also agree that jurisdiction shall be in the District of Columbia.

Use of the Colorectal Cancer Alliance’s website or other digital platform constitutes acceptance of these Terms and Conditions.
